A Tuesday filing in the Delaware Court of Chancery said that Elon Musk is set to be deposed by Twitter on September 26 – 27 as a part of the lawsuit that was filed by the company when Musk walked out of the buyout deal. This deposition can also be stretched to the 28th of September if it’s necessary.
This deposition will be done privately in law offices and is a part of the evidence collecting phase before the five-day trial which is set to begin on October 17 in the Delaware Court. Since April, both parties have accused each other of breaking their part of the agreement. Subpoenas have been issued to many personalities from Silicon Valley and Wall Street including, Jack Dorsey, Co-Founder of Twitter, Larry Ellison, Co-Founder of Oracle Corp, etc.

Apart from this, A Bloomberg Report suggests that Musk’s attorney, Alex Spiro will also be questioned on September 25. In this report, a law professor from the University of Pennsylvania, Larry Hamermesh said that it is odd that the company is questioning Musk’s attorney and that he wouldn’t have much to add due to legal obligations. While Twitter wants Musk to buy the company as per the original agreement i.e. at $54.20 per share, Elon Musk says that the company is showing a false picture of the number of bot accounts. After everything that has happened, Twitter has maintained that the platform has less than 5% bots and Elon Musk doesn’t believe it.
The company previously also alleged that Musk is merely trying to retrieve inside information to create his own competitor. While we are getting closer to the trial, both sides have subpoenaed around 100 people to make their cases strong, leaving no loopholes.
